If you do not agree with any part of these Terms, you must not use our Services. Your continued use of the Services following any changes to these Terms constitutes acceptance of those changes.

The following terms have specific meanings throughout this agreement:

- All products, features, applications, services, technologies, and software offered by Inhira, including estate planning document generation, online notarization facilitation, and document storage.
- ""User" or "You""
- Any individual or entity that accesses or uses our Services, whether registered or unregistered.
- "Account"
- A registered user profile created to access and use our Services.
- "Content"
- All text, graphics, images, documents, information, data, and other materials uploaded, submitted, or otherwise transmitted through the Services.
- "Estate Planning Documents"
- Legal documents generated through our Services, including but not limited to wills, powers of attorney, healthcare directives, and related instruments.
Eligibility
To use our Services, you must meet the following requirements:
- Be at least 18 years of age
- Be a legal resident of the United States or its territories
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Services under applicable law
- Provide accurate, current, and complete information during registration

Inhira provides an online platform for creating estate planning documents. Our Services include:

- Generation of customized estate planning documents based on your responses
- Facilitation of remote online notarization through third-party providers
- Secure storage and retrieval of your documents
- Educational resources about estate planning
While we strive to ensure our documents comply with applicable state laws, laws vary by jurisdiction and change over time. You are responsible for ensuring that your documents meet your specific needs and comply with the laws of your state.
User Accounts
To access certain features of our Services, you must create an account. When creating and maintaining your account, you agree to:

Payment Processing
Payments are processed through secure third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.
Refund Policy
Our refund policy varies based on the stage of service delivery:
- Full refund available if no documents have been generated
- Partial refund may be available if documents have been generated but not notarized
- No refund available after notarization has been completed
- Refund requests must be submitted within 30 days of purchase

Subscription and Renewal
Certain Services may include subscription components for ongoing access and storage. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.
Intellectual Property
All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design—are owned by Inhira, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use, subject to these Terms. This license does not include:
- Any resale or commercial use of the Services or their contents
- Any collection and use of product listings, descriptions, or prices
- Any derivative use of the Services or their contents
- Any downloading or copying of account information for another party
- Any use of data mining, robots, or similar data gathering tools
Your Documents
Estate planning documents generated through our Services are your property. We retain no ownership interest in your completed documents, though we maintain a license to store and display them to you as part of our Services.
User Content
You may submit information, documents, and other content through our Services ("User Content"). By submitting User Content, you:
- Represent that you own or have the necessary rights to submit the content
- Grant us a license to use, store, and process the content to provide our Services
- Acknowledge that we may access your content to provide customer support
- Accept responsibility for the accuracy and legality of your content
We do not claim ownership of your User Content. However, we may use anonymized and aggregated data derived from User Content to improve our Services.
Prohibited Conduct
When using our Services, you agree not to:
- Violate any applicable laws, regulations, or third-party rights

- Use the Services for any fraudulent or illegal purpose

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, INHIRA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF TITLE AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF THE SERVICES
We do not warrant that our documents will be valid in every jurisdiction or suitable for every situation. Laws governing estate planning vary by state and change over time. You acknowledge that:
- We are not a law firm and do not provide legal advice
- Our documents are based on general templates and may not address your specific circumstances
- You should consult with a licensed attorney for complex legal matters
- Proper execution (signing, witnessing, notarization) is your responsibility
- Changes in law may affect the validity of your documents
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INHIRA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any damages arising from your use or inability to use the Services
- Any damages arising from unauthorized access to your account or data
- Any damages exceeding the total amount you paid to us in the 12 months preceding the claim
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Inhira and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
- Any dispute between you and a third party regarding your estate planning documents
Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Services will immediately cease
- We may delete your account and associated data (subject to legal retention requirements)
- You remain liable for any obligations incurred before termination
- Provisions that by their nature should survive termination will remain in effect
You may terminate your account at any time by contacting us or through your account settings. We recommend downloading your documents before terminating your account.
Dispute Resolution
Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at legal@inhira.com to attempt to resolve any dispute informally. We will work in good faith to resolve the matter within 30 days.
Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
- Arbitration will be conducted in English
- The arbitrator's decision will be final and binding
- Judgment on the award may be entered in any court of competent jurisdiction
- Each party shall bear its own costs, unless the arbitrator rules otherwise
Class Action Waiver
YOU AND INHIRA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
Exceptions
Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized data access.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Maryland.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- We will notify registered users by email at least 30 days before material changes take effect
- We may display a notice on our website announcing the changes
- Your continued use of the Services after changes become effective constitutes acceptance
If you do not agree to the modified Terms, you must stop using the Services and may request deletion of your account.
